Urbanplus (a wholly owned subsidiary of Hutt City Council) manages applications for private use of Hutt City Council land including the use of roads and drainage reserve land managed by Council and the airspace above this land.
Private use applications normally fall into the following categories:
Easement
This refers to a right to use Council land for a particular purpose only (e.g. to pass across Council land or for services under or over Council land). Easements are normally in perpetuity and have clear agreements setting out the right to use the Council land which are registered on both the Council title and the User’s title. Easements can not be granted over “road”. For information on making an application for an easement please refer to the following attachments:

Encroachment
An encroachment licence can be issued for private use of Council land where structures will be permitted, for example building over the boundary into Council road reserve. Private use allowed under an encroachment licence may not necessarily allow exclusive use of the land in question. Disposal
This refers to when a private user wishes to buy Council land for example drainage reserve. If you would like to apply to buy Council land please write to urbanplus with your request. An initial investigation will be undertaken to see whether the land needs to be retained by Council or may be sold.
Leasing
This refers to an agreement between the parties under which the terms and conditions are binding on both parties. Terms will include a specified period - usually with a right of renewal, and rental review periods. For information on making an application to use HCC land please refer to the following attachments:
