Direct referral request and decision
On 21 August 2018 the applicant requested that the application for resource consent be directly referred to the Environment Court under Section 87D of the Resource Management Act 1991. This request was accepted under delegated authority on 11 September 2018. Correspondence about the process from here will be sent to those who made submissions.

Council's report for the Environment Court
Council has produced a report to be submitted to the Environment Court, in accordance with the requirements under Section 87F of the Resource Management Act.
The report details the proposal, compliance against the relevant rules and statutory documents, summarises the notification of the application and the submissions received. It also provides an assessment of the environmental effects of the proposal and a list of suggested conditions to the Court.
The report does not include a recommendation to grant or decline the application.
Hutt City Council has received an application from Summerset Villages (Lower Hutt) Limited to construct a new retirement village, at the above address, being Lot 1 DP477960. This involves:
- a mixture of villas (self-contained units), self-contained apartments, serviced apartments, care rooms and memory care rooms, contained in a range of buildings
- associated earthworks, installation of services and an internal roading network
- removal of potentially contaminated soil
- and, construction in six stages over a period of up to five years.
The proposal is a restricted discretionary activity within the District Plan’s General Residential activity area. The application includes an assessment of environmental effects. The council has concluded that those effects warrant public notification.
