Land use consent

If you are proposing an activity or a building that is unable to meet all the rules and development standards requirements of the District Plan.

If appropriate, you may use the Affected Parties approval form.

You can use the Assessment of Environmental Effects template.

You can apply for a subdivision and land use consent together in one application.

Sec88 RMA

Deemed Permitted

Boundary Activity

If you are proposing a structure/building that breaches only a boundary rule in the District Plan, and the relevant adjoining properties are privately owned.

Use the Permitted Boundary Activity form.

You need written approval from the property adjoining the boundary violation.

Does not apply to boundary setbacks involving public boundaries; land use consent must be sought instead.

Certificate of compliance

If your activity complies with all rules of the District Plan and any relevant National Environmental Standard.

Sec139 RMA

Deemed Permitted Marginal or Temporary Activity

If you consider the activity proposed creates only a marginal or temporary non-compliance with a rule of the District Plan and Council could consider it to be a permitted activity.

Subdivision consent

If you are proposing to subdivide land including a boundary adjustment, unit title, cross lease update or freehold subdivision.

You must engage a professional surveyor.

You can apply for a subdivision and land use consent together in one application.

Survey plan approval

(Sec223 certification)

If you have had a subdivision consent decision issued by Council and you have prepared a survey plan to be deposited with Land Information New Zealand to begin the process of creating new land parcels.

Use the 223/224c application form.

You must engage a professional surveyor for a scheme plan.

Physical works approval

(Sec224 certification)

If you have had a subdivision consent decision issued by Council and you have met all the conditions of that subdivision consent.

Change or cancellation consent conditions

If you have a resource consent decision issued by Council and you require a change or cancellation to one or more conditions of that resource consent.

Your documents must clearly propose the changes and indicate them when appropriate on any plans. Our role is to assess the changes you propose, not to propose changes for you.

Sec127 RMA

Extension of lapsed time

If you have a resource consent decision issued by Council and you have not yet commenced the activity, but the timeframe in which to give effect to the consent is running out.

Include the decision document of the consent you wish to extend.

You cannot request the extension of an expired consent.

Right of way Approval

If you are creating a right of way over land that will be registered on a record of title.

Resource consent objection

If you have had a resource consent decision issued by Council and you object to a part or parts of the decision or fees. Also applicable for rejected applications during vetting.

Outline Plan of works

For Requiring Authorities carrying out an activity on a site that has been designated in the District Plan.

The planned activity must be entirely within the designation and consistent with the rules and purposes indicated in the relevant appendix, else the designation status does not apply and the proposal must be submitted as a land use consent instead.

Sec176A RMA

Outline Plan waiver

For works being undertaken by Requiring Authorities on a designated site, which do not need Outline Plan of Works approval.

The planned activity must be entirely within the designation and consistent with the rules and purposes indicated in the relevant appendix, else the designation status does not apply and the proposal must be submitted as a land use consent instead.

Notice of requirement

To designate land in the District Plan for a specific purpose to be carried out by a Requiring Authority.

Alteration of designation

For a Requiring Authority to request changes to a notice of requirement for a designated site within the District Plan.

Sec181 RMA

Subdivision via Sec226 certification

If you need certification to allow a certificate of title to be issued for a separate allotment on a survey plan.

Cancellation or variation of consent notice

If you have a consent notice registered on a title and you would like to change or cancel the wording of the consent notice.

Cancellation of amalgamation condition

If you have an amalgamation interest registered on your title pursuant to s241 of the RMA, and you would like to cancel the requirement for land to be held together.

Sec241 RMA

Surrender/cancellation or variation of easement

If you have an easement registered on the record of title under s243 of the RMA for a property that you wish to remove or amend.

Sec243 RMA

Removal of Building Line Restriction on Record of Title

To remove Building Line Restrictions on the record of title, which prevent building within the front of the property.

Public Works Act 1981

National Environmental Standard (NES)

If you trigger a National Environmental Standard rule. A NES Regulation is a set of national rules separate to the District Plan (e.g. plantation forestry, contaminated soils). An activity may be permitted under a NES but needs consent under the District Plan and vice versa.

Please contact the Resource Consents Team. As a guide the following activities are captured by a NES:

  • Subdividing,   soil disturbance or a change of land use activity for a contaminated site
  • Telecommunication   facilities

Sec88 RMA

Existing use rights

A retroactive consent for an established activity that doesn’t have a resource consent to operate, but was otherwise lawfully established at some prior time.
